KFDM/Fox 4 News has learned a suspect is charged with Intoxication Manslaughter in a crash late Saturday night on Major Drive that killed a 78-year-old woman who would have celebrated her birthday next Saturday. A retired longtime judge who is the suspect's uncle released a statement to KFDM/Fox 4 on behalf of the family, telling us the accident wasn't his nephew's fault, his nephew maintains he wasn't impaired, and he isn't receiving any favorable treatment. Sgt. Tom Swope tells KFDM police responded to a two vehicle crash at 11:58 p.m. Saturday in the 3500 block of Major Drive near Claybourn Drive, close to Folsom. Sgt. Swope says the suspect was arrested on scene and transported to the Jefferson County Jail. The victim was transported to CHRISTUS St. Elizabeth Hospital where she died. Family members identify her as Charlotte Nicholas, 78. Justice of the Peace Ben Collins Sr. tells KFDM Ky Kollin Walker, 28, is charged with Intoxication Manslaughter With a Vehicle. If convicted of the 2nd Degree Felony, he could face 2-20 years in prison and up to a $10,000 fine. He was booked into the Jefferson County Jail early this morning. Collins tells KFDM/Fox 4 News he arraigned Walker this morning and set bond at $50,000. The jail says Walker was released this morning after posting bond. The judge set conditions including that Walker use an ignition interlock device on any vehicle operated within 30 days of his release. Family members tell KFDM Nicholas was leaving The Providence on Major apartments when the crash took place. They say she "was a sweetheart and she'll truly be missed." Nicholas would have celebrated her 79th birthday this coming Saturday. Retired longtime judge Layne Walker is the uncle of Ky Walker. He released a statement to KFDM/Fox 4 News on behalf of the family. “Ky Walker is my nephew," said Walker. "Ky was on his way home and was involved in a tragic accident that wasn’t his fault. Ky maintains he wasn’t impaired and is awaiting the toxicology report. It’s a tragedy. We’re thinking about this precious lady and our sorrow goes out to her family. The system is trustworthy. There is no favorable treatment. We have a car wreck and a precious lady died. Let the system work. I’ll spend every waking moment helping to defend my nephew and we have full faith in District Attorney Keith Giblin and his office.”
