Kirbyville Police arrested a man on charges of Aggravated Assault with a Deadly Weapon Against a Family Member and Resisting Arrest.
According to the probable cause affidavit, Sergeant Josh Hancock was dispatched to an active assault call at the residence of Mrs. Johnnie Breed. Dispatchers reported hearing a man in the background sounding agitated and yelling. The residence and individual involved were already familiar to local law enforcement due to multiple prior incidents.
Sergeant Hancock, Police Chief Paul Brister, and Justice of the Peace Mike Smith responded to the scene. Mrs. Breed, 83, told officers that her son, Eric Breed, entered her home demanding his Social Security card. When she told him to pack up and leave, Eric reportedly became enraged, grabbed her arm, and threatened her, saying he was “going to get rid ofher.” She managed to pull away, but Eric allegedly struck her with a walking stick and punched her multiple times.
Mrs. Breed escaped and called the sheriff’s office, telling dispatch she feared for her life. She armed herself with a pair of scissors for protection, but Eric took them from her and also took control of the phone.
She told officers she wished to pursue a protective order.
Police then approached the separate building behind the main residence where Eric lived. When they contacted him through the open door, he was nude and immediately became aggressive. Officer Hancock ordered him to show his hands, but Eric instead charged at the officers. Hancock drew his Taser and warned him to stop. As Eric tried to shut the door, Hancock and JP Smith prevented him from closing it completely. Hancock then deployed a drive stun to Eric’s arm, causing him to retreat, and officers were able to place him under arrest.
Eric Breed was transported to the Jasper County Jail.
In the audio recording from dispatch, Mrs. Breed can be heard saying Eric “jumped on her” and threatened to kill her. Eric then grabbed the phone and shouted profanities at dispatchers before hanging up. Due to the severity of the situation and Mrs. Breed’s age, officers requested a protective order be issued by the court.
